Social Media Terms of Use

The Windsor-Essex County Health Unit (WECHU) welcomes your participation on WECHU’s social media accounts. Please review these terms of use carefully.

Social Media Participants are bound by the Terms of Use

WECHU’s social media accounts represent WECHU’s presence on social media platforms provided by third party service providers, such as: YouTube, Facebook, SnapChat, Instagram, LinkedIn, Twitter, and Tik Tok. Participation on these platforms is subject to the terms of use of the relevant third party and we encourage you to read their terms of use before engaging with us through our social media accounts. Participation is also subject to these terms of use. Some of our social media accounts may have additional terms of use. Please check each platform. By participating, you are agreeing to be bound by all applicable “Terms of Use.” If you do not agree to be bound by the Terms of Use, please do not engage with WECHU’s social media accounts.

No Waiver by WECHU

WECHU’s failure to insist upon or enforce strict performance of any provision of the Terms of Use shall not be construed as a waiver of any term or condition. No course of conduct shall act to modify any provision of the Terms of Use, unless agreed to in writing by WECHU.

Intended Participants

The services of WECHU are offered to the residents of Windsor and Essex County. If you reside outside of this area, you are welcome to participate in our social media accounts, but we also encourage you to contact your local public health authorities.


WECHU strives to make all of its social media content accessible.  If you are not able to access information on a WECHU’s social media platforms, please contact our Communications Department at 519-258-2146 extension 6397.  

WECHU Content

Content displayed by WECHU on its social media accounts will cover various topics related to public health, including, but not limited to, WECHU campaigns, relevant health information for our region, 3rd party web content of interest, advisories and warnings, job postings, and news releases.

WECHU Posting Frequency

The number of posts by WECHU will vary depending on relevant material available each day and the platform. During some periods, we may post more or less frequently than average. Most new WECHU social media posts will occur during regular working hours, Monday to Friday from 8:30 a.m. to 4:30 p.m. eastern standard time (EST). Any posting during holidays or after regular working hours will likely be time sensitive, an emergency, or an urgent communication of significant value to our social media community. Otherwise, WECHU will be relatively inactive during these times.

Proper Use

You may not violate the law in your use of our social media accounts. Further, you may not interfere or attempt to interfere with the proper working of our social media accounts or with another’s use and enjoyment of them through the use of any device, software, routine, imposition of large loads or otherwise.

Your Messages and Posts

WECHU social media accounts are accessible and visible to the public. Please do not post anything that you wish to keep confidential. You are responsible for your messages and posts and the following additional terms and conditions apply:

  • You may not the use WECHU’s social media accounts for any illegal purpose.
  • You may not encourage others to break the law.
  • You may not post any material that infringes on the intellectual property rights of others.
  • You may not post any material that infringes on the privacy rights of others.
  • You may not post any material that is defamatory, threatening, abusive, obscene, offensive or otherwise inappropriate such as lewd, vulgar, or profane comments, ethnic, racial or religious slurs, cyber bullying, depictions of violence and obscenity etc.
  • You may not post any material that constitutes an endorsement, advertisement or solicitation of business.
  • You may not post chain letters or pyramid schemes.
  • Your messages and postings must be relevant.
  • Your messages must be respectful.
  • You may not impersonate another person or falsely claim to represent the interests of any group or person.

Responding to your Messages and Posts

Depending on the volume of messages and posts, we cannot commit to responding to everyone. Further, we cannot guarantee that we will understand your message or post completely or respond accurately. You acknowledge that any response by WECHU:

  • Is not to be considered to be definitive advice or guaranteed to address your message or post.
  • Does not offer medical advice, diagnosis, or treatment. If you have a question about a specific medical condition, you should contact your primary health care provider. If you live in Ontario, you can also call Health811 at 8-1-1. If you are experiencing a medical emergency, please call 9-1-1. If you are inquiring about a specific service offered by WECHU (e.g., immunization records), please call us at 519-258-2146. If you have a public health matter and require assistance outside of WECHU regular office hours, you may contact the paging service at 519-973-4510.

If we feel your message or post requires a response and/or a greater level of detail, we may develop a formal response and distribute the information through other channels such as e-mail and WECHU website.

Registration and Passwords

You are solely responsible for maintaining the confidentiality of your social media platform access credentials such as for example, your username and password, and you may not allow any other person to use them in connection with WECHU`s social medial accounts. You will notify WECHU immediately of any such unauthorized use.

Products and Services

WECHU may make certain products and/or services including programs, promotions, and contests available through our social media accounts. Additional terms and conditions may apply to such products or services and you agree to abide by such other terms and conditions. If there is a conflict between these Terms of Use and the terms and conditions posted for, or applicable to, a specific product or service offered through our social media pages, the later terms shall control with respect to such product or service. WECHU may make changes to any products or services offered through our social media pages or to the terms and conditions that apply at any time and without notice.


While WECHU may moderate submissions and posts on our social media accounts, we are not required to, nor should you expect that, we will take action in response to any specific submissions or posts.

WECHU Right to Restrict Use

WECHU reserves the right (but shall not be obligated) in its sole unfettered discretion, at any time and from time to time to bar, block, or otherwise limit or restrict any person’s access to and use of WECHU social media accounts. WECHU also reserves the right to remove or modify any messages or materials posted, in whole or in part.


The content of WECHU social media accounts is the property of WECHU, unless otherwise noted. Such property includes but is not limited to: text, graphics, logos, images, and audio and video clips.

Any content submitted by you remains your property but by submitting it, you give WECHU an irrevocable license to use, reproduce, publish, display, transmit, modify and create derivative works of such content and you agree to waive any moral rights you may have in any such content, all without the requirement to recognize you or make payment of any compensation to you.

WECHU social media account content may not be reproduced, copied, modified, or published in whole or in part without the express, written consent of WECHU. WECHU encourages community partners and non-profit organizations to request permission to utilize our materials. To ask permission, please  complete the following form.

Email Marketing Service

Subscribing to receive emails from WECHU is voluntary. WECHU reserves the right to either modify or discontinue emails at any time with or without notice. We reserve the sole right to unsubscribe users / visitors from email services without notice. We do require all subscribers to confirm their email address upon registration. You will therefore receive a message with a link you'll have to click in order to confirm the email address and your will to subscribe.

Emails may be imported into email marketing services such as Mailchimp to communicate important public health messages to partners when deemed necessary. We reserve the sole right to unsubscribe users / visitors from email services without notice.

Performance analytics, such as click rates and open rates, are collected from each email campaign sent from Mailchimp to subscribers or identified partners on behalf of WECHU. This email marketing service collects data from a variety of sources including Google and social media channels.  Participation on Mailchimp is subject to the terms of use of the relevant third party and we encourage you to read their terms of use before engaging with us through email. By participating, you are agreeing to be bound by all applicable “Terms of Use.” If you do not agree to be bound by the Terms of Use, please do not engage with WECHU’s email marketing service. Social media posts may from time to time provide links to other websites, or we may like, share, follow or undertake similar activities in connection with our social media accounts. Such activities do not mean we have reviewed anything or constitute any kind of endorsement by us. WECHU does not assume responsibility whatsoever for the links or the policies or practices with respect to websites or other accounts accessed through our links, likes, shares, follows, or other similar activities.

Links provided as references within a web document or page are based on where information was gathered at the time it was written. In some cases, these links may be broken and no longer available. When this occurs, the link text will continue to be listed as the source reference, but without a hyperlink to the original source.

Third Party Material

The appearance of a participant in our social media accounts does not imply an endorsement by WECHU of any kind. Further, the availability of any postings or other material by persons outside of WECHU does not mean that we have reviewed it or constitute an endorsement by us.


Social media pages may contain advertisements. Unless otherwise specifically indicated by us, WECHU does not endorse or make any kind of representation or warranty with respect to such advertisements.


WECHU content on our social media accounts should not be taken as an expression of WECHU’s official position. Further, some WECHU staff may engage with social media accounts in their personal capacities and not as representatives of WECHU and any associated content does not represent the official position of WECHU. Any expression of WECHU’s official position will be communicated through official publications and formal statements to the media. Further, nothing on WECHU social media pages is intended as advice or to meet the specific needs of individuals as individual situations will differ. The information on our social media accounts is presented for general purposes. Visitors should not act or rely on the information without seeking specific advice from qualified professionals on matters of concern. We will not purposefully present inaccurate information, however information is supplied “as is” and may contain errors. We do not guarantee or warrant the quality, accuracy, completeness, timeliness, appropriateness, or suitability of WECHU social media accounts content. Reliance on any information appearing on WECHU social media accounts is at your own risk. We expressly disclaim all warranties, representations and conditions regarding use of social media accounts and its content.

Limitation of Liability

Neither WECHU nor any of its directors, officers, employees, agents, social media page contributors, assigns, and/or those for whom WECHU is responsible at law, shall be liable to you for any expense, loss, or damage suffered by you and/or any other person arising directly or indirectly at any time from the use of WECHU social media pages, or if the pages are modified or becomes unavailable whether reasonably foreseeable or not.


To the full extent permitted by applicable law, you agree to indemnify WECHU and its directors, officers, employees, agents, social media contributors and/or those for whom WECHU is responsible in law against any and all liability resulting from your use of WECHU’s social media accounts, including without limitation resulting from any violation of the Terms of Use, and additional terms and conditions that may apply and/or violation of any law.


The Terms of Use may change at any time and from time to time without notice at the sole discretion of WECHU. It is your responsibility to review the terms each time you access our social media accounts. Your continued use of WECHU social media accounts following the posting of changes will mean that you accept and agree to the changes.

Governing Law and Jurisdiction

The Terms of Use shall be construed and enforced in accordance with the laws of Ontario and the laws of Canada applicable therein. The forum for the settlement of any dispute relating directly or indirectly to the Terms of Use shall be the courts of Ontario located in Windsor, Ontario, Canada.

Privacy Statement

If you choose to engage with WECHU through our social media accounts, please note that we do not have any control over the third party social media platform providers or the manner in which they collect, use, disclose and otherwise manage your personal information. We encourage you to read the privacy policies of such third party social media platform providers before engaging with us through our social media accounts.

Collection of information from you by WECHU through our social media accounts and any subsequent use and disclosure by WECHU are subject to our privacy statement.
