Name of Contest: Infant Feeding Survey Gift Card Draw (the “Contest”)
WARNING! These Contest Rules affect your legal rights. Read them carefully!
In these Contest Rules,
“WECHU” means the Board of Health for the Windsor-Essex County Health Unit and includes its directors, officers, employees, volunteers, contractors, and other agents, plus the successors and assigns of each of the foregoing.
“Entrant” means a person who I eligible to participate in and has submitted an entry into the Contest in accordance with these Contest Rules.
“Entry” or “Entries” means a submission by an Entrant to participate in the Contest submitted in accordance with these Contest Rules.
- PARTICIPATING IN CONTEST
- By participating in the Contest, the Entrant agrees to be bound by these Contest Rules.
- Each Entrant also agrees to be bound by the Contest-related decisions of WECHU, which decisions may be made in the sole discretion of the WECHU and shall be final and binding in all respects.
- Entrants to the Contest consent to the use of their personal information collected on the entry ballot for the administration of the Contest. Entrants also consent to the disclosure of their personal information to third party service providers of WECHU for this purpose. WECHU will use personal information only for this purpose and for no other purpose whatsoever. Following the Contest, the name of the winner(s) may be posted on WECHU’s website, and/or social media accounts. WECHU will protect personal information in a manner consistent with applicable laws and WECHU’s Privacy Policy.
- All personal and other information requested by and supplied to WECHU by Entrants for the purpose of the Contest must be truthful, complete, accurate, and in no way misleading. WECHU reserves the right, in its sole discretion, to disqualify any Entrant should such Entrant at any point provide untruthful, incomplete, inaccurate, or misleading information.
- HOW TO ENTER
- The Contest runs from the onset of the Infant Feeding Survey (insert date) until such time the survey is closed. The Contest draw will occur quarterly, every January, April, July and October.
- No purchase or payment is necessary to enter or win the Contest. No entry fee is required to enter the Contest.
- To enter, complete the WECHU’s Infant Feeding Survey in its entirety. Incomplete surveys will not be considered valid entries.
- ELIGIBILITY
- This Contest is open to Windsor and Essex County, Ontario residents only.
- Entrants must be age 18 or over or if younger, have consent of a parent or legal guardian.
- Employees and representatives of WECHU, and employees’ and representatives of any person that provided advertising, promotional or other services to WECHU in connection with the Contest are not eligible to participate in the Contest. If a person is not eligible to participate in the Contest in accordance with this paragraph, the ineligibility shall also apply to any member of their household, and any related corporations of such person, and any corporation in respect of which such a person is an officer, director, or shareholder.
- ENTRIES
- An eligible Entry to the Infant Feeding Survey Gift Card Draw is the completion of the Infant Feeding Survey on the online platform. Entrants can make an eligible Entry into the Contest
- Any Entry deemed by the WECHU to be inappropriate or not suitable may be disqualified at the sole discretion of the WECHU.
- By making an Entry, an Entrant represents and warrants that the Entry:
- is original and all right, title, and interest (including copyright) therein and thereto is owned and/or controlled by the Entrant;
- does not violate any applicable law;
- does not infringe upon the intellectual property or other statutory or common law rights of any third party;
- does not violate the requirements of any social media platform used;
- is not defamatory, trade libelous, pornographic, obscene, or violent and,
- does not put anyone in a dangerous environment or situation.
- Entries become the sole property of the WECHU, and each Entrant waives any moral rights they may have.
- Each Entrant acknowledges that the WECHU may publish Entries in whole or in part on any medium, including without limitation, social media and the WECHU’s website for the purposes of contest transparency.
- By participating in the Contest, Entrants grant to the WECHU an unlimited, royalty-free and irrevocable, right and license to use, reproduce, display, post and/or broadcast their entries in any form, media or technology now known or later developed, including but not limited to the WECHU social media accounts, its website (www.wechu.org) and printed materials. Entrants further waive any copyright that they may have in their Entries. Entrants represent and warrant that they own and control all rights in relation to their Entries and have the right to grant the foregoing rights to the WECHU.
- There is a limit of 1 Entry per Entrant. Multiple survey submissions from the same Entrant will be disqualified.
- PRIZES
- There shall be 2 prizes per quarter for the duration of the survey.
- Prizes consist of one of two gift cards valued at $50.
- Prize(s) shall be as is and may not be exchanged or refunded for an amount of money, sold, or transferred.
- Each entrant is only eligible to win one prize.
- The odds of winning the Contest are dependent upon and determined by the number of eligible Entries. The WECHU is unaware of how many Entries there may be.
- If an Entrant fails to claim a prize within forty-eight (48) hours of notification, the Entrant will forfeit the prize. If the Contest requires a group Entry all members of the group must claim their prize in the specified time frame.
- PROCEDURE FOR AWARDING PRIZES
- The Contest runs from the onset of the Infant Feeding Survey (January 2026) until such time the survey is closed.

The Contest will be divided into 4 (four) entry Quarters every year.
Quarter # Start Date End Date Quarter #1 01/01/2026 03/31/2026 Quarter #2 04/01/2026 06/30/2026 Quarter #3 07/01/2026 09/30/2026 Quarter #4 10/01/2026 12/31/2026 - Entrants will be selected by in random drawings (two draws per Quarter) conducted by the WECHU within five (5) days of the Quarter end date. Two (2) potential Entrants will be selected in each drawing.
- Note, entries do not carry over into the subsequent Quarters.
- In the event that there is an error of any sort resulting in more winning Entrants than prizes, then winners will be selected by random draw from among such group.
- WECHU will attempt to notify selected Entrant(s) through the contact information provided. Selected Entrant(s) must respond as directed by the WECHU, within forty-eight (48) hours of notification. Failure to do so may result in disqualification. WECHU assumes no responsibility for any failure in communications from or to the selected winner(s).
- Upon successfully answering the skill testing question, the selected Entrant will become the winner of the Contest. Should the selected Entrant not correctly answer the skill testing question, a second skill testing question of the same sort will be provided. Upon successfully answering the second skill testing question, the selected Entrant will become the winner of the Contest. Should the selected Entrant again prove unable to answer the skill testing question, that Entrant will not win the Contest.
- Winners may be required by the WECHU to acknowledge receipt of the prize in writing and that it is subject to these Contest Rules.
- By participating in the Contest, Entrants consent to having their name released as the winner on the WECHU social media accounts and being contacted by the WECHU staff for contest-related purposes.
- Entrants who are not winners will not be notified.
- If the selected Entrant does not respond within forty-eight hours of notification, does not meet all of the Contest conditions, or fails to correctly answer the skill testing question, the Entrant forfeits any rights to the prize. Another Entrant may be randomly selected from the remaining eligible Entries. In such case, WECHU reserves the right in its sole and absolute discretion to decide whether to select an alternate winner, or no winner at all. WECHU is not responsible for the failure for any reason whatsoever of a selected Entrant to receive notification or for WECHU to receive a selected Entrant’s response.
- The decision of WECHU regarding the winning ballot, success on the skill testing question, and the eligibility of the winner is final and binding.
- GENERAL
- These Contest Rules shall be deemed to be amended to comply with any applicable federal, provincial and municipal laws or the policy of any entity having jurisdiction over the WECHU.
- WECHU further has the right to amend these Contest Rules, and to suspend or to terminate the Contest at any time, for any reason or no reason whatsoever, without notice, liability or further obligation to any Entrant or other persons.
- WECHU has the right to disqualify an Entrant, if in the opinion of WECHU, the Entrant has breached these Contest Rules or, in any way, acted inappropriately, including without limitation, by being untruthful, incomplete, inaccurate or misleading.
- Any attempt by an Entrant to deliberately damage any website or to undermine the legitimate operation of this Contest, is a violation of these Contest Rules and may be a violation of criminal and civil laws.
- EACH ENTRANT ACKNOWLEDGES THAT WECHU ASSUMES NO LIABILITY FOR ANY LOSS, DAMAGE OR INJURY, INCLUDING WITHOUT LIMITATION: (I) LOST, STOLEN, DELAYED, DAMAGED, MISDIRECTED, LATE, DESTROYED, ILLEGIBLE OR INCOMPLETE ENTRIES; (II) LOSS, THEFT OR DAMAGE TO SOFTWARE OR COMPUTER OR TELEPHONE DATA, INCLUDING ANY BREACH OF PRIVACY; (III) FRAUDULENT CALLS; (IV) INABILUITY OF ANY PERSON TO PARTICIPATE IN THE CONTEST FOR ANY REASON INCLUDING TECHNICAL, COMPUTER OR TELEPHONE MALFUNCTIONS OR OTHER PROBLEMS WITH COMPUTER ON-LINE SYSTEMS, SERVERS, ACCESS PROVIDERS, COMPUTER EQUIPMENT, OR SOFTWARE; CONGESTION ON THE INTERNET OR AT ANY WEBSITE, OR ANY COMBINATION OF THE FOREGOING; (V) DAMAGE TO ANY PERSON’S COMPUTER, INCLUDING ANY MATERIAL RELATING TO THE CONTEST; (VI) ANY DELAY OR INABILITY TO ACT RESULTING FROM AN EVENT OR SITUATION BEYOND THEIR CONTROL, INCLUDING A STRIKE, LOCKOUT OR OTHER LABOUR DISPUTE AT THEIR LOCATION OR THE LOCATIONS OF THE ORGANIZATIONS AND BUSINESSES WHOSE SERVICES ARE USED TO ADMINISTER THIS CONTEST.
- Each Entrant releases and holds WECHU harmless from any and all liability for any injuries, loss or damage of any kind to an Entrant or third party, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in the Contest, any breach of the Contest Rules, or in any related activity.
- Each Entrant agrees to indemnify and hold harmless the WECHU from and against all claims, demands, causes of action, suits or other proceedings, liabilities, costs, sums, damages and expenses (including legal and other professional fees), by whomsoever made and whether direct, indirect or consequential resulting from, occasioned by or attributable in any way to an Entrants acts or omissions and/or any breach of these Contest Rules. For greater clarity, this indemnity is not limited to third party losses and specifically includes the first party losses of the WECHU.
- Each Entrant acknowledges that the Contest is not sponsored, endorsed, or administered by the provider of any social media used in this Contest, including as applicable, Meta (i.e., Facebook, Instagram), X, LinkedIn and/or Snap Group Limited, and each Entrant completely release all such social media providers from any and all claims in connection with this Contest.
- Notwithstanding any other provision, any particular entitlement, right or remedy of the WECHU provided for in these Contest Rules, these Contest Rules do not preclude the WECHU from any other entitlement, right or remedy available at law or otherwise and further, no right or remedy is exclusive or dependent on any other entitlement, right or remedy and the WECHU may exercise any one or more of its entitlements, rights or remedies independently or in combination, such rights, entitlements or remedies being cumulative and not alternative.
- These Contest Rules shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
- WECHU is not responsible for any Entries lost, late, misdirected, containing inaccurate information, or delayed for any reason. By accepting the prize, the winner agrees to all disclaimers stated as part of the Contest. The winner, by acceptance of the prize agrees to release WECHU, its affiliates, subsidiaries, advertising, promotional agencies, and service providers from any and all liability claims or actions of any kind whatsoever. WECHU will have no further obligation to the winners other than the prize awarded. Prizes are not transferable and cannot be exchanged, substituted or redeemed for cash, except that WECHU may, in its sole discretion, substitute a prize for another prize or prizes of equal or greater value.
- WECHU shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the Contest. WECHU accepts no responsibility for loss, damage or claims caused by or resulting from the Contest or acceptance of a prize. WECHU will not be responsible for late, lost, undeliverable, illegible, incomplete, falsified, tampered with, altered or destroyed Entries for any reason and all such Entries will be void. In the event it is determined that an Entrant has entered in a fashion not sanctioned by these Contest Rules and/or has submitted more than the number of Entries permitted by these Contest Rules, the Entrant will be disqualified and all of the Entries submitted by the Entrant will be void. WECHU is not responsible for any typographical, human or other error in the printing of the Contest and/or collateral advertising materials, administration of the Contest, processing of the Entries or in the announcement of the prize winners or in any other materials or information associated with the Contest. WECHU will not be liable, and does not assume any responsibility, for incorrect or inaccurate capture of Entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. WECHU is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive information by the WECHU on account of technical problems, or on account of traffic congestion on the internet or at any website or any combination thereof.
- WECHU reserves the right to terminate, suspend, or extend the Contest or to amend these Contest Rules at any time and in any way, without prior notice.
RIGHTS RESERVED
The WECHU reserves the right, in its sole discretion to cancel or suspend this Contest should fraud, virus,
bugs or other causes beyond the control of the WECHU corrupt the administration, security, or proper play of the Contest. With respect to computer Entries, the WECHU is not responsible for computer system, phone line, hardware, software or program malfunctions or other errors, failures or delays in computer transmissions or network connections, whether human or technical in nature. The WECHU reserves the right at its sole discretion, to disqualify any Entrant (and all of their Contest entries) who tampers with the entry process.
NOTICE: The personal information collected by the WECHU in connection with the Contest, is collected under the legal authority of the Health Protection and Promotion Act. It will be used and disclosed for the purposes of administering the Contest and as otherwise contemplated by these Contest Rules.
