November 2025 Board of Health Meeting - Parking Lot Lease Recommendation Resolution
BACKGROUND
The WECHU entered into a one-year Parking Lease Agreement with Havs Real Estate Development GP Inc. (HAVS) on January 1,2025 for 36 parking spaces located at Dufferin and Erie Street. The Lease is automatically extended, unless terminated by the WECHU, for successive one-month periods from January 1,2026 to December 31,2026. The monthly lease amount is $3,297 or $39,564 per annum.
In September, the WECHU was informed that the lot containing the 36 parking spaces had been sold to Erie Centre Inc. (ERIE) who would be taking over the lease. The WECHU entered into discussions with ERIE. At the same time HAVS offered to the WECHU further spaces on an adjacent property. After discussions with both parties, two (2) Parking Lot Agreements were negotiated with HAVS and ERIE for a total of 58 parking spaces.
The Parking Lot Agreements with HAVS and ERIE contain substantially the same terms:
- Lease term of 3 years commencing on October 1,2025 and terminating on September 31,2028. There is a mutual termination for default clause.
- The Leases are automatically extended, unless terminated by the WECHU, for successive one-month periods from October 1,2028 to September 30,2029. The Landlord may, on 90 days prior written notice, terminate the Lease.
- The annual lease amounts are as follows:

RECOMMENDATION
It is recommended that the WECHU proceed with the HAVS Parking Lot Lease and the ERIE Parking Lot Lease for the following reasons:
- Parking is a major concern for the employees of the WECHU as available street parking is limited. The additional 22 parking spaces will allow more employees have access to guaranteed parking spaces.
- The additional parking spaces provide assurance to staff and clients during peak times of operation.
- Previously, the landlord would only commit to one-year terms thus causing uncertainty as to the available parking for the employees and the annual lease amount. The new Parking Lot Agreements provide a for 3year terms with termination only due to default.
PROPOSED MOTION
Whereas, the WECHU has negotiated Parking Lot Agreements with HAVs Real Estate Development GP Inc. and with Erie Centre Inc. for fifty-eight (58) parking spaces.
Whereas, the new Parking Lot Agreements provide more parking spaces as well as term and price certainty for three (3) years.
Now therefore be it resolvedthat the Windsor-Essex County Board of Health approve the execution of the Parking Lot Agreement with Havs Real Estate Development Inc. GP for 34 parking spaces and the execution of the Parking Lot Agreement with Erie Centre Inc. for 24 parking spaces.
FURTHER THAT, the Chief Executive Officer and/or the Director, Corporate Services and CFO be authorized to execute the Parking Lot Agreements and all ancillary documentation necessary to give effect to the above.
